California car accidents: street racing leads to man's death

Most California drivers practice safety when operating a motor vehicle: wearing seat belts, obeying traffic signs and road rules and adhering to posted speed limits. For some reason likely unknown to most responsible drivers, some people enjoy street racing, and it is not uncommon for such behavior to lead to car accidents. Sadly, one recent incident of this completely unsafe practice has robbed a man of his life.

The crash happened late on a recent Sunday evening when, according to witnesses, two sporty vehicles were seen racing on a San Jose street. Police were then called to that area, and when they arrived, they found one of the vehicles had crashed into a tree on the traffic median. The passenger, a 24-year-old man, died at the crash scene. The driver, a 27-year-old man, was taken to a local hospital with injuries not considered life-threatening.

The driver, while still in the hospital, has been charged with vehicular manslaughter and felony DUI causing death. Following the accident, police issued a public announcement asking the driver of the other vehicle involved in the road race to come forward and add his side of the story to the investigation. That driver has since appeared before police and was subsequently arrested on several charges: felony hit and run causing death, felony reckless driving causing death and felony street racing.

Unfortunately, two individuals' decisions to act recklessly has led to very serious consequences, the least of which is the charges they now face. Worse, a young man is dead. Undoubtedly, most California residents would agree that fatalities resulting from car accidents of this type are most disturbing, since they appear to be a direct result of poor judgment. Although the deceased victim was a passenger in one of the racing vehicles, he may not have been a willing participant in the action that resulted in his death. His grieving family may be entitled to pursue a wrongful death lawsuit against one or both of the drivers.
