Older people, slip-and-fall accidents and premises liability

It is a reality of life that the older one gets, the less steady one becomes. It is estimated that at least 25 percent of people over 65 years of age fall in a single year. While California may have fewer sidewalks made slippery by ice, there are many other hazards they still have to face.

It is quite disturbing to realize that 20 percent of falls in elderly people lead to serious injuries, mostly involving head injuries and/or broken bones. It is estimated by the Centers for Disease Control and Prevention that a minimum of 300,000 older people end up in hospital every year because of broken hips, and that 95 percent of these injuries can be blamed on a fall. It's interesting that people between the ages of 50 and 60 fall more frequently than those over 65, due to the fact that they are more active.

There are ways in which to fall to decrease the impact, according to people who fall for a living, such as stunt persons. Not tensing up, but rather trying to roll into a ball, may save one from pain and suffering. Unfortunately, falls happen suddenly and unexpectedly, and then it may not be so easy to remember exactly how to fall.

The fact is, it may not be that when one falls, it is purely by accident. Sometimes, a fall is caused by an unexpected wet floor, uneven walkway or poorly maintained surfaces. Shop owners and authorities in charge of the care and maintenance of public areas and sidewalks have a duty toward patrons, especially more senior patrons, to ensure that all surfaces are safe and hazard-free.
