Motorcycle accidents: Claims after passenger injuries a reality

Little compares to riding with someone on a bike on the open California road. Many say the feeling of freedom one experiences is next to none, but the reality is that motorcycle accidents seldom end well for either party. Both biker and passenger are exposed on a motorcycle and therefore accidents often lead to serious injuries.

One can hardly believe the fact that the moment a passenger gets onto the bike, the weight of the bike increases between 20 and 30 percent. This is why a biker should check to see if the bike can handle the extra weight and if adaptations to the suspension should be done before inviting a passenger along. The increase in weight would also require the biker to make some adjustments to his or her driving habits and to be extra vigilant in regards to normal safety measures.   

Many states require a bike to have a separate seat for a passenger, as well as footrests. It is the duty of a biker to check if the motorcycle meets the legal requirements before inviting a passenger onto it. It may be a good idea to discuss certain safety tips with riders, especially if they have never been on a bike before. Important aspects to discuss include when to get onto the bike, the importance of holding on, to follow the body movements of the driver, the dangers of sudden movements and the importance of keeping his or her feet on the footrests.

California civil law allows victims of another person's negligence or recklessness, or his or her family members in the case of death, to choose to file a personal injury or wrongful death claim. Seriously injured passengers, or the legal estates of a deceased passenger, may decide to sue bikers seeking financial damages. A successfully litigated case may result in compensation to the victims of motorcycle accidents, or their families, where negligence or recklessness was deemed the root cause of the accident.
