Premises liability claim after slip-and-fall accident

Businesses have a legal duty to ensure that customers are safe from injury on their premises. A disregard for the safety of clients may lead to customers being injured when tripping or slipping. The plaintiff alleges that she suffered serious injuries to her shoulder and neck after she slipped on an unswept floor and consequently stumbled into a soda display. According to the plaintiff, her injuries have resulted in two surgeries. In court the footage recorded by the security camera was showed the plaintiff suddenly becoming unsteady as she pushes her shopping cart between two checkout points. She then staggers and hits the display shelf.

In its defense, the company maintains that the woman was not seriously hurt and that the pain she claims originates from pre-existing conditions. The lawyers representing the company also made use of the camera footage to provide evidence in defense. The footage includes many customers using the same aisle and not slipping as well as the plaintiff taking heavy items out of her shopping cart after she slipped.

While it will be up to the jury to decide the outcome of this case, it is important for Californian victims who suffer serious injuries in slip-and-fall accidents to understand their rights in terms of filing a premises liability claim.
