Trucking accidents are often devastating and deadly

Large semitrailers crisscross the roads of California on a daily basis. Unfortunately, this also means that the occupants of much smaller passenger vehicles are at significant risk. When large trucks are involved in a fatal accident, the occupants in a smaller vehicle are more likely to lose their lives.

These big rigs are as much as 20 times heavier than passenger vehicles, are much higher off the road surface and obviously taller, making it easy for a low, small vehicle to slide under them. While some trucks have a safety device -- a rear underride -- it has been proven to be ineffective even in crashes at low speed. Fortunately, these guards are being improved and even developed for the sides of trailers.

Fatigued drivers and the braking capability of large rigs are responsible for many fatal crashes. While commercial truck drivers are only allowed to drive for 11 hours at a time, truckers often ignore these federal regulations. Something many road users overlook is the fact that trucks take a lot longer to stop than passenger vehicles, especially in adverse weather conditions or if not properly maintained.

California law allows for seriously injured victims of trucking accidents, or the legal estate of deceased victims, to pursue civil claims against alleged negligent truck drivers and/or their employers. Monetary damages awarded in a successfully litigated claim could help a victim better cope with medical bills, rehabilitation costs and any lost wages due to missed time from work. A successful wrongful death claim could allow the victim's surviving loved ones to better cope with financial losses, such as lost wages, funeral and burial costs.
