Trip-and-fall accident results in claim against property owners

Governmental authorities and property owners have a duty to ensure that public premises, such as shops, restaurants, offices, sidewalks and parks, are safe for the public to use. They are also legally required to post clear signage about any hazardous areas. Should a member of the public suffer any injuries due to property owners ignoring their duties, a civil claim may follow. In early May, a claim was filed against Californian property owners after a woman was injured in a trip\-and\-fall accident.

The plaintiff claims she tripped over an elevated part of the sidewalk just after turning a corner. It is alleged that there is an inch or more difference in height between the two slabs of pavement, caused by tree roots pushing up. Originally, a claim was filed against the county and city of San Francisco. However, the city denied liability, claiming that the property owners are the parties responsible for maintaining the sidewalk.

According to the plaintiff, she broke a tooth in the fall, and suffered injuries to her face, shoulder, hand and knee. She is asking for a ruling in terms of general damages as well as dental expenses and medical expenses. She is also asking for costs and any other relief considered appropriate by the court.

Public places should be safe to use and California pedestrians who have suffered serious injuries due to a trip-and-fall accident on uneven pavements, shop floors or other public hazards may benefit from consulting with a personal injury lawyer. A lawyer can evaluate the circumstances surrounding the accident. An objective evaluation will help establish the options for legal recourse, including a premises liability lawsuit against the property owners and/or governmental authority for damages sustained.
