Pedestrian versus car accidents lead to serious injuries

People walking next to a busy road, albeit on a sidewalk or not, are vulnerable and dependent on the driving skills of all the drivers passing them on the road. Car accidents involving pedestrians seldom end well for the pedestrian. A recent accident in California underscores the vulnerability of pedestrians.

Four students were struck by a pickup truck shortly after 3 p.m. as the students were leaving their school. Eyewitnesses report the car speeding before cutting off a second car, which led to the driver spinning out of control as he could not make the lane change. The driver of the pickup truck, a 19-year-old man, has been arrested. According to the police reports, he is facing a felony charge of reckless driving.   

An eyewitness describes seeing the students flung toward the gate and then lying on the ground. While none of the four injured students suffered life-threatening injuries, they were sent to hospitals in the immediate area. One of the victims had to be operated on. Reports indicated that the victims suffered broken bones, bruises and facial injuries.

While it is not clear exactly how severe the injuries suffered by the students were, one mother seemed to have expressed concern about medical costs. Pursuant to Californian law, seriously injured victims of car accidents  have the choice to file personal injury claims against a driver and/or other party based upon evidence of negligence or recklessness. When a victim has not reached the age of majority, a parent or guardian can bring the action of the victim's behalf. Regardless of the outcome of a related criminal case, the families of the injured victims may benefit from consulting with a personal injury lawyer for an evaluation of their individual cases and to discuss what steps should be taken to pursue recovery of monetary damages incurred.
