Bicycle and auto accidents: California boy suffers consequences

A recent accident in California involving two cyclists and a pickup truck clearly illustrates the vulnerability of cyclists on roads in the Unites States. The accident happened on a Tuesday evening in July at approximately 8:45 p.m. A 16-year-old boy and his father were cycling in a suburban area at the time of the accident. Auto accidents involving bicyclists have the potential to cause serious injury to the less-protected bicycle riders, as made evident in this case.

According to California police reports, the young man was struck by a driver of a pickup truck from behind. He was then dragged along for at least a 100 feet. Only then did the driver stop his vehicle. The boy's father was also hit by the truck.

The two bicyclists were cycling on the edge of the road, not in the road. Witnesses have indicated that they saw the pickup truck driver moving out of the lanes and onto the roadway's edge before he struck the cyclists. The father suffered minor injuries, but the 16-year-old was not that lucky. His injuries were serious and are considered life-threatening.

California civil law allows victims seriously injured in auto accidents the choice to file personal injury claims against allegedly negligent drivers. The family of this 16-year-old boy may, thus, elect to file a personal injury claim against the reckless pickup driver. Should the young man not survive, his legal estate may decide to file a wrongful death claim. Claims for financial losses may be made for medical and rehabilitation costs as well as funeral and burial costs in the case of death against the party whose negligent actions are deemed to have caused or contributed to the fatal accident.
