Helmets aren't just for safety

Many states, including California, have mandatory helmet laws for motorcycles. It may seem like government overreach and a "nanny" state, but it is done to encourage people to ride their motorcycle safely. Regardless of your opinion, if you are caught without a helmet, it could result in a ticket. Aside from the safety aspect, absence of a helmet could be used by the defendant to reduce the money that he or she owes you.

The way a typical personal injury lawsuit works is that you need to prove that you were injured and that the other party caused it through their own negligence. Once you can do that, you could be entitled to compensation.

But the defending party is allowed to submit evidence to show that you were also negligent. If they can prove that your negligence contributed to your injury, then that could serve as grounds to reduce the compensation you are owed.

Additionally, if the state you are in has mandatory helmet laws, the defendant may even use the absence of a helmet to argue that you were responsible for your own injuries. If this happened to you, you may want to speak to an attorney. This could get complicated very quickly and professional assistance could be helpful in protecting your interests.

If you were injured in an accident while riding your motorcycle, you may want to sit down with a lawyer at your earliest convenience. You may have a valid personal injury claim. Motorcycle injuries are typically more serious than car or truck accidents. Therefore, it is important that you get the compensation you deserve to pay for your medical bills and injuries. You were the victim; you shouldn't also be forced to pay for your own injuries.
