California accident leaves 2 dead and drunk driver arrested

Police in California have charged a 65-year-old motorist with drunk driving following a fatal car accident in which two people died. The arrested driver is also a suspect in a hit-and-run accident that preceded the fatal collision by a minute according to police.

According to the accident investigation, the negligent driver was seen drinking at the bar of a local steakhouse shortly before the accident. He was driving a pickup truck and towing a trailer. Both the truck and the trailer became airborne prior to drunk driving accident.

Liability for compensation of an accident victim or, as in this case, the family and loved ones of the victims is based upon theories of negligence. Drivers who are texting and driving and drivers holding their cell phone in their hand while engaging in a conversation are examples of distracted drivers who might be just as dangerous to other people using the roads as a negligent driver who gets behind the wheel of a motor vehicle after have too much alcohol to drink.

A person who suffers a serious injury, or the family of someone killed in an accident with a drunk driver or with a negligent driver, might have a cause of action against the other driver whose intoxication and disregard for other people using public highways and roads can be proven to be the cause of the auto accident. One course of action that people have when they are involved in an auto accident with a drunk driver is to file a lawsuit against the driver for damages. Liability is based upon negligence. Filing such a lawsuit should be discussed with an attorney as soon after car accidents occur as possible.
